1. Acceptance of Terms

By downloading or using Kaptur (“the App”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Kaptur is a business expense tracking and project management application for iOS. The App allows you to record expenses, manage projects, create estimates and invoices, track subcontractors and vendors, and export financial data. Kaptur is designed as an organizational tool and is not a substitute for professional accounting, bookkeeping, or tax preparation services.

3. Not Financial or Tax Advice

Kaptur is an organizational and record-keeping tool only. All expense data, categorizations, tax calculations, and financial summaries displayed in the App are provided for informational and organizational purposes only and do not constitute financial, tax, accounting, or any other type of professional advice. AI-powered categorizations are suggestions and may not be accurate for your specific tax situation. You are solely responsible for verifying the accuracy of your records and consulting qualified professionals for tax and financial matters.

4. Subscription & Billing

Kaptur Pro Subscription

• The Kaptur Pro subscription unlocks premium features including unlimited projects, expanded estimate limits, unlimited subcontractors & vendors, advanced reporting, unlimited CSV exports, and AI-powered expense categorization.
• Subscriptions are billed through your Apple ID account at the price shown at the time of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your iPhone Settings under Settings → Apple ID → Subscriptions.
• All purchases are final. Refunds are handled by Apple in accordance with their standard policy.

Free Tier

A free version of Kaptur is available with limited features (limited projects, estimates, and export capabilities). We reserve the right to modify the features available in each tier at any time with reasonable notice.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated scripts to scrape or abuse the App's functionality
• Interfere with the security or integrity of the App
• Use the App to generate fraudulent invoices or estimates

6. Data Accuracy

Kaptur provides tools for recording and organizing your business data. We make no guarantees about the accuracy of AI-powered categorization, receipt scanning (OCR), voice transcription, or tax calculations. You are responsible for verifying all data entered into the App, whether manually or through automated features. We are not liable for any errors resulting from automated data extraction or categorization.

7. Intellectual Property

All content, branding, and code within Kaptur are the intellectual property of the developer. You may not reproduce, distribute, or create derivative works without written permission. Your business data and exported documents remain your property.

8. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that any specific feature will be available at all times. We do not warrant the accuracy of receipt scanning, voice recognition, or AI categorization features.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to financial losses resulting from inaccurate data entry, categorization errors, lost data, or reliance on information displayed in Kaptur.

10. Data Loss

Since Kaptur stores all data locally on your device, we are not responsible for data loss resulting from device failure, app deletion, iOS updates, or any other circumstance. We strongly recommend regularly exporting your data using the CSV export feature to maintain backup copies of your financial records.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the App following any changes constitutes your acceptance of the new Terms. The “Last Updated” date will always reflect the most recent version.
